FROSTY'S WAREHOUSE PRIVACY POLICY

This Policy governs the way in which Frosty's Warehouse collects, uses, maintains and discloses information collected from our users (each, "You") of the Frosty's Warehouse website ("Site"). This privacy policy applies to this website and all products and services offered by Frosty's Warehouse.

We may collect personal identification information from You in various ways, including, but not limited to, when You visit our site, register on our site, place an order, subscribes to a newsletter, fill our a form and in connection with other activities, services, features or resources we make available on our Site.  You may be asked for, when placing an order, such information as, your name, email address, shipping address, contact phone number, credit card  or payment information. You may, however, visit our Site anonymously.  We collect this personal identification information from You only if you voluntarily agree and submit such information to us.  You may refuse to supply personally identification information, except that it may prevent you from engaging in activities such as online sales.

NON-PERSOANL IDENTIFICATION INFORMATION 

We mat collect non-personal identification information about You whenever you interact with our Site.  Non-personal identification information we collect may include your browser name, the type of computer you are using and technical information about  your means of connection to our Site.  This information is used primarily to improve the service we provide to You.

We may use the email address to send information and updates relating to your order.  It may be used to respond to inquiries made to Frosty's Warehouse customer services.  If You decide to opt-in to our mailing list, You will require emails that may include company news, updates, relating to product or services, etc.  If at any time that You would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

How we protect your information

We take all reasonable steps to keep secure any information which we hold about you.  Personal information may be stored both electronically on our computer system, and in hard copy form.  Firewalls, SSL encryption, passwords, anti-virus software and email filters act to protect all our electronic information.

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

We do not store credit card information, we securely submit credit card information to our bank for processing.

Sharing your personal information

We do not sell, trade or rent Users personal identification information to others.  We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.  We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys.  We may share your information with these third parties for those limited purposes provided that your have given us your permission.

THIRD-PARTY WEBSITES

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties.  We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site.  In addition, these sites or services, including their content and links, may be constantly changing.   These sites and services may have their own privacy policies and customer service policies.  Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website's own terms and policies.

CHANGES TO THIS PRIVACY POLICY

Frosty's Warehouse has its sole discretion to update this privacy policy at any time.  When we do, we will revise the updated date at the bottom of this page.  You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

INTELLECTUAL PROPERTY RIGHTS

1. Unless expressly provided herein, Frosty's Warehouse reserves all intellectual property rights in our Site and nothing in these terms constitutes a transfer of any intellectual property rights.
2. All our trademarks, trade names, logos, imagery, photography, graphics and ad videography used on the Site are owned by us.  You may not use, reproduce, copy, republish, upload, transmit, post or modify our trademarks in any way without our prior written consent.
3. By posting or adding any content onto our Site  (including, without limitation, comments, feedback, ideas or suggestions posted by you through the Site), you grant us a perpetual, non-exclusive, royalty free, irrevocable, worldwide and transferable right and licence to use that content in any way (including, without limitation, by reproducing, changing and communicating the content to the public) and you permit us to authorise any other person to do the same thing.
4. You consent to any act or omission which would otherwise constitute an infringement of your moral rights, and if you add any content in which any party has moral rights, you must also ensure that the third party also consents in the same manner.

PRICING AND PAYMENT

1. Prices displayed on the Site (including the price of the goods and delivery charges) are in Australian Dollars and, if GST applies, inclusive of GST.
2. Prices for the goods are separate and distinct from delivery and/or handling fees.
3. We reserve the right to change or alter prices without notice to you.  If you have already submitted an order at a particular price, we will supply your goods at that price.
4. Payment for the goods and any applicable delivery and/or handling fees are required in full on placement of the order.
5. We do not collect or store your debit or credit card information. All debit and credit transactions on the Site occur through third-party payment gateway (the "Processor").  You hereby authorise the Processor to procure payment from your nominated payment method.
6. While all reasonable steps will be taken to protect your debit and/or credit card information, given the nature of the internet, we cannot guarantee the security of any such information, and subject to any gross negligence on our part, we will not be held liable for any loss you suffer as a result of any unauthorised access to your debit and/or credit information.
7. Once we received your order, the Processor will perform a standard pre-authorisation check on your credit or debit card and, to that end, you hereby authorise the Processor to perform this check.
8. Your order will not be dispatched/ready for pickup until payment has cleared.  In the event payment does not clear, we will cancel your order and notify you accordingly.
9. Payment methods are specified on the Site at the time you place your order.

YOUR ACCEPTANCE OF THESE TERMS

By using this Site, your signify your acceptance of this policy and terms of service.  If you do not agree to this policy, please do not use our Site.  Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
